Submitting a Notification of Claimed Infringement

If you believe that material available on the Service infringes a copyright you own or control, please send our designated agent a written notification that includes substantially the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works on the Service are covered by a single notification, a representative list of those works.
  3. Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient to permit us to locate the material (for example, a link to the listing or profile and a description of where the material appears).
  4. Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Upon receipt of a valid notification, we will respond expeditiously to remove, or disable access to, the material identified in the notice and will take reasonable steps to notify the user who posted it.

Counter-Notification

If material you posted was removed or disabled and you believe this was the result of a mistake or misidentification, you may send our designated agent a written counter-notification that includes substantially the following, as required by 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Paradays LLC may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.

If we receive a valid counter-notification, we will forward it to the person who submitted the original notification. Unless that person notifies us that they have filed an action seeking a court order against the user, we may restore the removed material in not less than 10 and not more than 14 business days after receiving the counter-notification.

Repeat Infringers

It is our policy, in appropriate circumstances, to terminate the accounts of users who are determined to be repeat infringers.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. Please make sure your notice or counter-notice is accurate before submitting it.
